Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the HBCUMADE website, mobile application, text messaging program, events, and related products and services collectively referred to as the “Services.”
The Services are operated by HBCUMADE INC. (“HBCUMADE,” “we,” “us,” or “our”). By accessing or using the Services, creating an account, registering for an event, or opting into our text messaging program, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, you should not access or use the Services.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services. By using the Services, you represent that you meet these requirements.
2. HBCUMADE Services
HBCUMADE provides digital community, networking, event, career, educational, and engagement services designed primarily for students, graduates, alumni, supporters, institutions, and members of the Historically Black College and University community.
We may add, remove, suspend, or modify features of the Services at any time. We do not guarantee that every feature or Service will always be available.
3. Accounts and Account Security
Some Services require you to create an account. You agree to:
Provide accurate, current, and complete information
Keep your account information updated
Protect your password and login credentials
Notify us promptly of suspected unauthorized access
Accept responsibility for activity conducted through your account
You may not impersonate another person, misrepresent your identity or affiliation, create an account for someone else without permission, or use another person’s account.
We reserve the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, create risks for other users, or interfere with the operation of the Services.
4. Community Standards
You agree not to use the Services to:
Harass, threaten, intimidate, exploit, or harm another person
Post unlawful, fraudulent, defamatory, discriminatory, obscene, or abusive content
Share sexually explicit content or content that exploits or endangers minors
Impersonate another person or organization
Violate another person’s privacy or intellectual property rights
Distribute spam, malware, malicious code, or unauthorized advertisements
Collect user information without proper authorization
Circumvent security features or interfere with the Services
Use automated systems to scrape, copy, or access the Services without permission
Engage in conduct that violates applicable laws or regulations
We may review, restrict, remove, or report content and activity that we reasonably believe violates these Terms, our policies, or applicable law.
5. User Content
You may be able to submit profiles, photographs, messages, comments, event information, and other materials through the Services (“User Content”).
You retain ownership of your User Content. By submitting it, you grant HBCUMADE a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and otherwise use that content as reasonably necessary to operate, improve, promote, and provide the Services.
You represent that you own or have permission to submit your User Content and that its use by HBCUMADE will not violate another person’s rights or any applicable law.
You may request removal of certain User Content or deletion of your account by contacting us. We may retain information when required for legal, security, fraud-prevention, or legitimate business purposes.
6. Events, Tickets, and Purchases
HBCUMADE may offer event registration, tickets, memberships, sponsorships, subscriptions, merchandise, or other paid products and services.
Prices, refund policies, event requirements, and other purchase terms may be displayed at checkout or in an event description. Those additional terms become part of your agreement with us when you complete the applicable purchase.
Unless otherwise stated in writing, purchases are nonrefundable except where required by law or when HBCUMADE cancels an event without providing an alternative remedy.
Event dates, venues, speakers, honorees, programming, and schedules may change. HBCUMADE is not responsible for travel, lodging, transportation, or other expenses incurred in connection with an event unless we expressly agree otherwise in writing.
7. SMS and Text Messaging Terms
By providing your mobile number and actively opting in, you agree to receive recurring text messages from HBCUMADE. Messages may include event announcements, ticket information, community updates, platform news, member opportunities, promotional messages, and customer-care communications.
Message frequency varies. Message and data rates may apply.
Consent to receive marketing text messages is not a condition of purchasing a product, registering for an event, or using the Services.
You may opt out at any time by replying STOP to a HBCUMADE message. After submitting a STOP request, you may receive one final message confirming your opt-out. You may reply HELP for assistance or contact us at info@hbcumade.app.
Opting out of text messages does not automatically unsubscribe you from email or other communications. You must follow the unsubscribe instructions provided through each communication channel.
Wireless carriers are not responsible for delayed or undelivered messages. Message delivery is subject to your wireless carrier’s network availability and policies.
HBCUMADE does not sell or share mobile numbers, text-message opt-in data, or consent records with third parties or affiliates for their independent marketing or promotional purposes. We may share information with service providers that help us operate the messaging program, subject to appropriate confidentiality and data-protection obligations.
8. Intellectual Property
The Services and their original content, branding, logos, designs, software, features, and functionality are owned by or licensed to HBCUMADE and are protected by intellectual property laws.
“HBCUMADE,” associated logos, and related brand elements may not be copied, modified, displayed, or used without our prior written permission.
These Terms do not transfer ownership of HBCUMADE intellectual property to you.
9. Third-Party Services and Links
The Services may contain links to third-party websites, applications, ticketing platforms, payment processors, social networks, or other services that HBCUMADE does not control.
We are not responsible for the content, availability, security, products, policies, or practices of third parties. Your use of third-party services is governed by the terms and policies of those providers.

By using the Services, you acknowledge that you have reviewed the Privacy Policy.
11. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, HBCUMADE disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
HBCUMADE does not guarantee that:
The Services will always be available, secure, or error-free
Information provided through the Services will always be accurate or complete
Use of the Services will result in employment, admission, mentorship, funding, business opportunities, donations, professional relationships, or other specific outcomes
Other users will provide accurate information or behave appropriately
You are responsible for evaluating people, organizations, opportunities, advice, and information encountered through the Services.
12. Limitation of Liability
To the fullest extent permitted by law, HBCUMADE and its directors, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services.
Where liability cannot legally be excluded, HBCUMADE’s total liability for claims arising from the Services will not exceed the greater of the amount you paid directly to HBCUMADE during the 12 months preceding the claim or $100.
Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HBCUMADE and its directors, officers, employees, contractors, affiliates, and service providers from claims, damages, losses, liabilities, and reasonable expenses arising from:
Your use or misuse of the Services
Your User Content
Your violation of these Terms
Your violation of another person’s rights
Your violation of applicable law
14. Suspension and Termination
You may stop using the Services at any time.
We may suspend, restrict, or terminate access to the Services if we reasonably believe you have violated these Terms, created a security or legal risk, harmed another user, or misused the Services.
Sections that by their nature should survive termination will remain effective, including provisions concerning intellectual property, disclaimers, liability, indemnification, and dispute resolution.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
Before filing a legal claim, you agree to contact us and attempt to resolve the dispute informally. If a dispute cannot be resolved informally, it will be handled by a court with appropriate jurisdiction in Georgia, unless applicable law requires otherwise.
16. Changes to These Terms
We may update these Terms to reflect changes to the Services, our business practices, or applicable legal requirements.
The updated Terms will be posted on this page with a revised effective date. Your continued use of the Services after the revised Terms become effective constitutes acceptance of the updated Terms.
